These Terms of Service ("Terms") govern your use of the services provided by Philipp Rufinatscha ("we," "us," or "our"), including our portfolio website rufinatscha.me and the general business relationship for our portfolio of SaaS applications such as Confirma.io, Proofolio, and PDFConfirm (collectively, the "Services").

When you use any individual service, both these general Terms and the service-specific terms apply. In case of conflict between these general Terms and service-specific terms, the service-specific terms take precedence for that particular service.

We reserve the right to modify, suspend, or discontinue any Service at any time with reasonable notice to users. For SaaS applications with their own terms, modifications will be governed by both these general terms and the service-specific terms.

• Auto-Renewal: Subscriptions automatically renew unless cancelled before the next billing cycle
• Price Changes: We may modify pricing with 30 days' notice to existing subscribers
• Taxes: Prices exclude applicable taxes, which you are responsible for paying

7. Refund and Cancellation Policy

• Cancellation: You may cancel your subscription at any time through your account settings
• Service Continuation: Cancelled subscriptions remain active until the end of the current billing period
• Refunds: Generally, we do not provide refunds for unused portions of subscriptions
• Exceptions: Refunds may be considered for technical issues preventing service use or within 14 days of initial purchase
• EU Consumer Rights: EU consumers have additional withdrawal rights under applicable consumer protection laws

Our Content: All content, features, and functionality of our Services are owned by us and protected by copyright, trademark, and other intellectual property laws.

Your Content: You retain ownership of content you upload or create using our Services. By uploading content, you grant us a limited license to:

• Back up your content for service reliability and recovery

This license terminates when you delete your content or close your account, except for content shared publicly or required for legal compliance.

• 100% uptime or uninterrupted service availability
• Error-free operation or immunity from security threats
• Compatibility with all devices, browsers, or software
• Immediate resolution of technical issues

We provide technical support during business hours (9 AM - 5 PM CET, Monday-Friday) via email. Response times vary based on the complexity of your inquiry and your subscription level.

11. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability for any claims related to the Services is limited to the amount you paid us in the 12 months preceding the claim
• We are not liable for indirect, incidental, special, consequential, or punitive damages
• We are not responsible for data loss, business interruption, or lost profits
• Our liability does not extend to third-party services, content, or integrations

These limitations do not apply to damages caused by our gross negligence or willful misconduct, or where prohibited by applicable law.

You agree to defend, indemnify, and hold us harmless from any claims, damages, or expenses (including reasonable attorney fees) arising from your use of our Services, violation of these Terms, or infringement of third-party rights.

13. Termination

We may terminate or suspend your access to our Services:

• For violation of these Terms or our policies
• For non-payment of fees
• For prolonged inactivity (12+ months)
• At our discretion with reasonable notice

Upon termination, your access ends immediately, but these Terms survive regarding indemnification, liability limitations, and dispute resolution.

14. Governing Law and Dispute Resolution

These Terms are governed by Austrian law. For dispute resolution:

• Informal Resolution: Contact us first to resolve disputes amicably
• Jurisdiction: Austrian courts have exclusive jurisdiction for legal proceedings
• EU Consumers: EU consumers may also use their local courts under applicable consumer protection laws
• Online Dispute Resolution: EU consumers can use the ODR platform at https://ec.europa.eu/consumers/odr/

15. Changes to Terms

We may update these Terms periodically to reflect changes in our Services, legal requirements, or business practices.
